Background  

On the 3rd July 2023 the DLUHC published guidance on Section 156 of the Building Safety Act 2022 which came into force on the 1st October 2023. Section 156 amends the Regulatory Reform (Fire Safety) Order 2005. 

Buildings, especially high-rise residential buildings, are now subject to two different regulatory regimes which are enforced by two different regulators. The local Fire and Rescue Service consider all buildings under the Regulatory Reform (Fire Safety) Order 2005 (The Fire Safety Order) whilst, the Building Safety Regulator considers higher-risk residential blocks under the Building Safety Act 2022 and its secondary legislation. 

These changes have sparked some confusion where, for example, local FRS’s only require a Type 1 Fire Risk Assessment in order to meet the requirement of the Fire Safety Order, whereas, under the guidance issued by the Home Office/BSR a ‘whole building’ approach is required which, therefore, means that a Type 3 Fire Risk Assessment is necessary. 

The enactment of Section 156 of the Building Safety Act 2022 has led to confusion relating to the coverage and content of Fire Risk Assessments for all types of buildings including residential blocks and we’re here to demystify the guidance.
